A means whereby one spouse passes assets to the other spouse on their demise instead of willing it to them. The value of the assets acquired directly by the surviving spouse can be up to the Federal Estate Tax exemption threshold with the remainder being held by the trust. In this way, no tax is payable until the death of the surviving spouse who, meantime, can receive income from the assets that are held in trust.
